Surrogacy and Donor Evaluations in New Jersey
New Jersey is one of the more protective states for gestational surrogacy. The New Jersey Gestational Carrier Agreement Act, signed into law in 2018, made gestational surrogacy agreements legally enforceable and set clear standards for them. One of those standards matters directly here: New Jersey law requires both the gestational carrier and the intended parents to complete a psychological evaluation as a condition of a valid agreement. The carrier must also be at least 21, have given birth before, and pass medical screening, and both sides must have independent legal counsel. New Jersey is also inclusive, with the law open to single, married, partnered, and same-sex intended parents.
Because the evaluation is written into the law itself, it is not optional, and clinics and agencies will expect it completed by a qualified, licensed clinician. We provide that evaluation for both carriers and intended parents.

Do gestational carriers in New Jersey need a psychological evaluation? Yes. New Jersey law requires the gestational carrier to complete a psychological evaluation approving her suitability before the agreement is valid. It is a legal requirement, not only an agency preference.
Do intended parents need an evaluation in New Jersey too? Yes. New Jersey is one of the states where the law also requires intended parents to complete a psychological evaluation. We provide both the carrier and the intended parent evaluations.
Are evaluations done in person or virtually? Virtually. All evaluations and consultations are completed by secure telehealth and are available anywhere in New Jersey, including Newark, Jersey City, Princeton, and Hoboken.
