Surrogacy and Donor Evaluations in Florida
Florida is a surrogacy-friendly state with a clear statute, and it has specific requirements worth understanding early. Gestational surrogacy is authorized under Florida Statutes section 742.15, which makes a contract enforceable only when the commissioning couple is legally married and a physician documents a medical need, meaning the commissioning mother cannot safely carry a pregnancy to term or doing so would pose a risk to her or the fetus. Intended parents who do not meet those criteria, including single and unmarried parents, can still pursue surrogacy in Florida through the preplanned adoption process under section 63.213.
Whichever pathway applies, Florida clinics and agencies typically require a psychological evaluation of the gestational carrier, and often her partner, as part of screening, and intended parents are commonly asked to complete a consultation.
