Surrogacy and Donor Evaluations in Michigan
Michigan recently became one of the country's newer surrogacy-friendly states. For decades it was the only state where compensated surrogacy was a crime, but that changed with the Michigan Family Protection Act, which took effect in 2025. Gestational surrogacy agreements are now legal and enforceable, and intended parents can obtain a pre-birth parentage order regardless of marital status, gender, or sexual orientation. The law sets clear standards, including that the gestational carrier be at least 21, have given birth before, and complete medical and mental health screening, with independent legal counsel for both sides.
