Arizona has no statute that authorizes gestational surrogacy agreements. An older statute, A.R.S. § 25-218, still prohibits surrogacy contracts, though a 1994 appeals court decision (Soos v. Superior Court) struck down the part naming the carrier as the legal mother. Parentage is set by Arizona superior court order, and practice varies by county and judge.
