Surrogacy and Donor Evaluations in Nevada
Nevada is one of the most surrogacy-friendly states in the country. Gestational surrogacy is expressly authorized by statute (NRS 126.500 through 126.810), and the law is open to all intended parents regardless of marital status, gender, or sexual orientation. Pre-birth parentage orders are available, and compensated agreements are permitted. The statute sets clear eligibility standards, including that the gestational carrier be an adult, have given birth before, and complete both medical and psychological evaluations, with independent legal counsel for each party.
Because Nevada's process is statutory and detail-specific, a clear psychological evaluation of the carrier, and often her partner, is a standard and expected part of screening. Frequently Asked Questions
Do gestational carriers in Nevada need a psychological evaluation? Yes. Nevada's surrogacy statute requires the gestational carrier to complete a psychological evaluation as part of eligibility, and clinics and agencies expect it before a match proceeds. It is a standard part of screening and is separate from therapy.
