Surrogacy and Donor Evaluations in Texas

Texas is one of the more established surrogacy states. Gestational surrogacy is expressly authorized under the Texas Family Code (Chapter 160, Subchapter I), and the gestational agreement must be validated by a Texas court before embryo transfer to be enforceable. The statute is written for married intended parents, and Texas courts have also validated agreements for unmarried and single intended parents at their discretion.

Because the Texas process is court-validated and detail-specific, alignment between the gestational carrier and intended parents before the agreement is signed matters a great deal. Most Texas clinics and agencies require a psychological evaluation of the gestational carrier, and usually her partner, as part of screening, and intended parents are often asked to complete a consultation as well.
