Surrogacy and Donor Evaluations in Washington
Washington has one of the clearest and most inclusive surrogacy frameworks in the country. The state's Uniform Parentage Act (Chapter 26.26A RCW), which took effect in 2019, expressly authorizes both gestational and genetic surrogacy and is open to all intended parents regardless of marital status, gender, or sexual orientation. Pre-birth parentage orders are available in gestational surrogacy cases, and compensated agreements are permitted.
What stands out for our work specifically: the Washington statute requires both the gestational carrier and each intended parent to complete a mental health consultation with a licensed mental health professional as part of eligibility. The evaluation is not optional, and clinics, agencies, and attorneys will expect it completed by a qualified clinician before the agreement is executed.
